It is important to note that some states’ requirements for both underground and aboveground storage tanks are more stringent than those of the federal government.

If your facility stores chemicals, oil or other substances underground, then several aspects related to the underground storage tanks (USTs) are federally regulated. They include:

• Performance standards for new and existing USTs
• Required notifications in the event of a release
• Spill and overfill control
• Corrosion protection
• Record keeping and reporting
• Release detection
• Release response
• Release reporting and investigation
• Closure of USTs

Should your facility store chemicals, oil or other substances aboveground, applicable requirements fall generally at the local and state levels. For example, Massachusetts regulates the use of tanks and/or containers for:

• Aboveground storage of combustible flammable liquids
• Underground storage
• Waste oil storage
